A planning aid — not a rescue service

WayUpThere does not monitor your trip, respond to emergencies, or contact search and rescue on your behalf. If you or someone in your party is in danger, use your satellite messenger's SOS or contact your local search-and-rescue authority, RCMP, or emergency services directly.

WayUpThere generates a starting point from the answers you provide. It cannot see your actual route, current conditions, the snowpack, water levels, weather, or your ability. Checklists and trip plans it produces may be incomplete, out of date, or wrong for your situation.

You are solely responsible for your own safety and decisions. Verify avalanche and water conditions with local authorities, confirm permits and regulations for your region, carry appropriate training and experience, and never let a checklist substitute for judgement. Backcountry travel in the North is inherently dangerous and can result in serious injury or death.

By using WayUpThere, you accept these risks and agree to the terms below.

1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the WayUpThere website and trip-planning tools (the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by the safety disclaimer above. If you do not agree, do not use the Service.

2. The Service

The Service helps you generate backcountry gear checklists and search-and-rescue trip plans based on information you provide. It is an informational and organizational tool only. It is not professional advice, a guiding service, a monitoring service, or an emergency service.

3. Assumption of risk & release of liability

You acknowledge that outdoor and backcountry activities carry inherent and significant risks, including the risk of serious injury, death, and property loss, and that these risks cannot be eliminated. You voluntarily assume all such risks. To the fullest extent permitted by law, you release WayUpThere and its operators from any and all liability arising out of or related to your use of the Service or any activity you undertake, whether or not planned with the Service.

4. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, or uninterrupted availability. Any conditions data, estimates (such as fuel or calorie figures), or recommendations are approximate and may be incorrect.

5. Limitation of liability

To the fullest extent permitted by law, WayUpThere will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of life, injury, data, or profits, arising from your use of or inability to use the Service.

6. Your responsibilities

  • Carry the training, experience, and equipment appropriate to your trip.
  • Independently verify conditions, hazards, regulations, and permits.
  • File your trip plan with a reliable person and carry a means of emergency communication.
  • Provide accurate information; the quality of any output depends on your inputs.

7. Accounts

Some features may require an account. You are responsible for the activity under your account and for keeping your credentials secure. You may stop using the Service and delete your data at any time.

8. Changes

We may update these Terms or the Service from time to time. Material changes will be reflected by an updated effective date. Continued use after changes constitutes acceptance.

9. Governing law

These Terms are governed by the laws of the Northwest Territories, Canada, without regard to conflict-of-laws principles.
